Welcome to With Ardour! The terms "we", "us", "our", "With Ardour", and "With Ardour London" refer to With Ardour London (trading as With Ardour). With Ardour London operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). With Ardour London is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your jurisdiction of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 – OUR PRODUCTS, MATERIALS & DISCLAIMERS

2.1 Representation & Availability

We make every effort to display the colours, textures, and details of our products as accurately as possible. However, the display quality, tonal depth, and saturation may vary depending on your device screen and individual display settings. All product descriptions and pricing are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product or limit purchase quantities at any time.

2.2 Natural Leather Characteristics & Inherent Delicate Qualities

We craft our pieces using genuine leathers and speciality skins. By purchasing, you acknowledge and agree that:

  • Inherent Delicate Qualities: Different leathers possess distinct physical traits. Certain varieties—such as soft sheepskin, fine nappa, hair-on calf, or foiled/printed finishes—are naturally delicate and supple by design. They are inherently more susceptible to surface scuffing, friction wear, creasing, moisture sensitivity, or natural shedding over time through regular handling and movement. This is an inherent characteristic of luxury natural skins, not a structural flaw or manufacturing defect.

  • Organic Variations: Genuine skins feature natural variations in grain texture, spot distribution, pore structure, and subtle tonal shading. No two finished pieces are identical.

  • Age & Patina: Genuine leather will naturally soften, stretch slightly, and develop a unique patina through everyday friction, hand oils, contact with cosmetics, heat, and direct sunlight.

  • Care Responsibilities: The customer is responsible for treating fine leather with reasonable care. Damage resulting from excessive friction (such as rubbing against coarse denim or abrasive bag linings), water submersion, chemical cleaners, or cosmetic staining is not considered a fault.

2.3 Device Fit, Compatibility & Hardware Disclaimer

  • Model Selection: The customer is solely responsible for selecting the correct device model at checkout. Because each case is tailored to exact dimensions, cases will not fit models other than the exact specification ordered.

  • Aesthetic Carry & Everyday Protection: Our accessories are designed as refined leather carry goods. While they provide surface coverage against everyday handling, With Ardour makes no warranty or guarantee that any case will prevent shock, structural breakage, screen damage, liquid ingress, or internal component failure resulting from drops, impact, or heavy pressure.

  • Limitation Regarding Personal Devices: With Ardour London accepts no liability for any damage, repair costs, or loss sustained by mobile phones, hardware, cards, or other personal property used in conjunction with our products.

2.4 Colour Transfer & Environmental Exposure

Richly dyed, printed, or untanned leathers may be subject to minor colour transfer when exposed to humidity, moisture, or heavy friction. Conversely, pale or delicate leathers may absorb dye from dark denim or saturated textiles. With Ardour is not liable for dye transfer to or from third-party garments, bags, or surfaces.

SECTION 3 – ORDERS & BESPOKE PRODUCTION

3.1 Offer & Acceptance

When you place an order, you are making an offer to purchase. With Ardour reserves the right to accept or decline your order for any reason at our discretion. Your order is not accepted until payment is processed and confirmation is issued. Purchases are intended for personal use only and not for commercial resale.

3.2 Made-to-Order & Custom Goods

Unless explicitly indicated as "ready to ship," our phone cases and accessories are cut, assembled, and finished made-to-order according to your selected device model and specifications. Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, statutory cancellation and change-of-mind rights do not apply to bespoke, personalized, or custom-made goods once production has commenced.

3.3 Order Amendments

Because bench production begins shortly after an order is received, requests to amend delivery addresses or device specifications must be submitted via email within 12 hours of purchase. Once hide cutting or assembly has begun, alterations cannot be guaranteed.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

You agree to provide current, complete, and accurate purchase, payment, and account information for all orders. You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are authorized to use the payment method, and (iii) charges incurred will be honoured by your provider at the posted prices, including shipping, handling, and applicable taxes.

SECTION 5 – SHIPPING, DISPATCH & CUSTOMS

5.1 Production Lead Times, Dispatch & Delays

Because our pieces are individually cut, shaped, and finished to order, orders require an estimated bench production window of 3–7 business days prior to dispatch. Delivery estimates selected at checkout apply from the date of carrier handover, not the date the initial order is placed.

In the event of production delays arising from curated hide availability, seasonal demand, or other unforeseen workshop circumstances, With Ardour will notify you via email and provide an updated estimated dispatch date. Reasonable delays do not entitle the customer to immediate cancellation once leather cutting or custom production has commenced.

5.2 Inaccurate Delivery Information & Returned Shipments

Customers are responsible for providing complete and accurate shipping details at checkout. With Ardour London is not liable for packages delivered incorrectly or lost due to address errors submitted by the customer. If a parcel is returned to our studio as uncollected, undeliverable, or refused, the customer is responsible for any applicable return fees and the cost of reshipment.

5.3 Delivery Estimates & Risk of Loss

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, postal strikes, or severe weather events. Once we transfer products to the carrier, risk of loss passes to you.

5.4 Customs, Duties & Import Taxes

Orders dispatched outside the United Kingdom may be subject to local import taxes, customs duties, and brokerage fees levied once the shipment reaches your destination country. All such additional charges are the sole responsibility of the customer. With Ardour has no control over these charges and cannot predict what they may be.

SECTION 6 – INTELLECTUAL PROPERTY & TRADEMARKS

6.1 Brand Ownership

Our Services, including all trademarks, brands, text, designs, images, graphics, audio, video, and the selection and arrangement thereof, are owned by With Ardour London (trading as With Ardour), its affiliates, or licensors and are protected by copyright, trademark, and intellectual property laws. These Terms permit you to use the Services for personal, non-commercial use only.

6.2 Third-Party Trademarks & Compatibility

References to third-party brand names, device models, or trademarks (such as Apple or iPhone) are used strictly to describe compatibility and intended fit for our accessories. With Ardour is an independent design studio and is not affiliated, associated, authorized, or endorsed by these third-party manufacturers.

SECTION 7 – OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide you with access to third-party tools or links to third-party websites which we neither monitor nor have control over. You acknowledge and agree that we provide access to such tools "as is" and "as available" without warranties of any kind. We have no liability whatsoever arising from your use of optional third-party tools or visits to external websites.

SECTION 8 – RELATIONSHIP WITH SHOPIFY

With Ardour London is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with With Ardour London. Shopify is not responsible for any aspect of sales between you and With Ardour London, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims arising from your transactions with With Ardour London.

SECTION 9 – PRIVACY POLICY

All personal information collected through the Services is subject to our Privacy Policy. Because our store is hosted by Shopify, certain personal data is processed by Shopify to operate and improve checkout and store infrastructure. If you submit ideas, suggestions, product reviews, or other materials (collectively, "Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such Feedback in any medium for any purpose, including commercial marketing. We are under no obligation to maintain Feedback in confidence, pay compensation, or respond.

Occasionally, information on our site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, transit times, or availability. We reserve the right to correct any errors, update information, or cancel orders if any information is inaccurate at any time without prior notice (including after order submission).

EXCEPT AS EXPRESSLY STATED BY WITH ARDOUR LONDON, THE SERVICES AND ALL PRODUCTS DELIVERED TO YOU ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, DURABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WITH ARDOUR LONDON, TRADING AS WITH ARDOUR, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, REPLACEMENT COSTS, OR HARDWARE REPAIR/REPLACEMENT COSTS ARISING FROM YOUR USE OF ANY OF THE PRODUCTS OR SERVICES, OR FOR ANY CLAIM RELATED TO YOUR USE OF ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ERRORS OR OMISSIONS IN ANY CONTENT.

SECTION 15 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless With Ardour London, trading as With Ardour, Shopify, and our affiliates, partners, officers, directors, and contractors from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

SECTION 16 – SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms, without affecting the validity of remaining provisions.

These Terms of Service and any policies posted on this site constitute the entire agreement between you and With Ardour London, governing your use of the Services and superseding any prior agreements.
